Terms of Service

These Terms govern your use of Snap It Away at snapitaway.ai (the “Service”), operated by Groundswell Trading LLC, a Florida limited liability company (“we,” “us,” or “Groundswell”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Invite-only beta

Snap It Away is an early prototype / beta. Access may be invite-only. Features can change, break, or be removed without notice. We may limit capacity, rate-limit AI, or pause the Service for maintenance.

2. Your content

You own the photos, notes, and listing copy you upload or create (“Your Content”). You grant Groundswell a limited, worldwide, non-exclusive license to host, process, display, and transmit Your Content solely to operate the Service for you (including AI identification, pricing suggestions, and preparing marketplace packages). We don’t claim ownership of your items or your listings.

3. Your responsibilities

• You’re responsible for the accuracy of titles, descriptions, prices, condition, and category before anything goes live.
• You must follow eBay, Facebook Marketplace, Mercari, OfferUp, Nextdoor, and any other marketplace’s rules, prohibited-items policies, and local law.
• You confirm you have the right to photograph and sell (or donate/gift/dispose of) the items you process.
• Nothing is posted to any marketplace without your explicit OK in the app (for example Publish, Export, or copy-and-paste yourself).

4. AI suggestions — estimates only

Identity guesses, price suggestions, comps, and disposition recommendations are automated estimates. They can be wrong. They are not appraisals, legal advice, or a guarantee you’ll sell at that price. Always review before listing.

5. No warranty

The Service is provided “as is” and “as available” during beta, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant uninterrupted or error-free operation, or that AI output will be accurate.

6. Limitation of liability

To the fullest extent allowed by law, Groundswell Trading LLC and its members, officers, and agents won’t be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost listings, marketplace suspensions, or data loss, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the fees you paid us for the Service in the 12 months before the claim, or (b) $50. Some jurisdictions don’t allow certain limits; in those places, our liability is limited to the maximum permitted.

7. Accounts and termination

You’re responsible for keeping login credentials secure. We may suspend or terminate accounts that abuse the Service, violate these Terms or marketplace rules, or harm other users. You may stop using the Service and request deletion via Data deletion or by emailing us.

8. Paid plans and billing (coming later)

The Service is free during this beta. When we add paid plans (for example via Stripe), we’ll update these Terms with pricing, renewal, cancellation, and refund details before charging you. We won’t bill you without clear notice and your agreement to a paid plan.

9. Changes to these Terms

We may update these Terms. We’ll change the “Last updated” date above and, for material changes, try to notify you by email or an in-app notice. Continued use after changes means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Courts in Florida have exclusive jurisdiction, except where applicable law gives you mandatory rights elsewhere.
